5.0 External Hosting and CDN

Our websites are hosted on servers in Germany, which are made available by technology service provider Amazon Web Services EMEA SARL, 38 avenue John F. Kennedy, L-1855, Luxembourg (AWS). This service provider or the primary internal recipient of personal data from the U.S.A. is listed under the EU-U.S. Data Privacy Framework. The processing of personal data by this service provider or the primary internal recipient is therefore classified as trustworthy by the European Commission.

Moreover, we use the content delivery network (CDN) of service provider Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107, USA. This service provider or the primary internal recipient of personal data from the U.S.A. is listed under the EU-U.S. Data Privacy Framework. The processing of personal data by this service provider or the primary internal recipient is therefore classified as trustworthy by the European Commission.

A CDN is an online service which helps with delivering files – particularly large media files (such as graphics, page contents or scripts) – using a network of regionally distributed servers connected via the Internet. Using the CDN helps us to optimise the loading speeds of our website.

This processing takes place pursuant to Art. 6 para. 1 (f) GDPR on the basis of our legitimate interests in the secure and efficient provision and improvement of our website’s stability and functionality. An agreement on order processing has been concluded with this service provider.  You will find more information on the data stored when you visit our website in the next section.

6.0 Server log files

If you only use our websites merely for information purposes, meaning that you do not register or otherwise send us information, we only collect the personal data your browser transmits to our server. The following data is always collected when you visit our website:

  • IP address of the user
  • Date and time of the request/access
  • Time zone difference from Greenwich Mean Time (GMT)
  • Contents of the request (specific page)
  • Access status / HTTP status code
  • Data volume transferred
  • Website from where the request is coming (which redirected the user’s system to our website)
  • Website called up by the user’s system via our website
  • Information about the browser type and the version used
  • Operating system and interface
  • Browser software language and version

We temporarily store this data, such as your IP address, which we require for technical reasons to display our website for you and ensure its stability and security. The legal basis for this is our legitimate interest according to Art. 6 para. 1 (f) GDPR.

7.0 Other Usage Forms of our Website

7.1 Contact Forms

Our website has various forms that you can use to contact us. When these forms are used, the data entered in the input mask is transmitted to us and stored. The mandatory fields are marked with an asterisk. In addition, your IP address and the date and time of the request are stored.

We can also be contacted by using the specified e-mail addresses. In this case, your personal data transmitted with the e-mail will be stored and processed by us in order to take care of your enquiry or the reason why you contacted us.  We may forward this data to companies affiliated with us. The data will only be used to process the conversation.

When contacting you, we only process the data for the purposes stated in the respective form. The legal basis for processing your data when contacting you is your consent pursuant to Art. 6 para. 1 (a) GDPR

7.2 Job application portal

If you apply for a job offer or send us an unsolicited application, we will process the data you provide in order to handle your application. Generally, your documents contain special categories of personal data (e.g. marital status information; information about your health; a photograph that allows conclusions about your ethnic origin and possibly your eyesight and/or religion to be drawn; similarly sensitive data within the meaning of Art. 9 GDPR).

The legal basis for processing applicant data is Art. 88 (1) GDPR in conjunction with. Section 26 of the Federal Data Protection Act (BDSG), as such processing is necessary for deciding whether to establish an employment relationship.

Please be aware that we work together with service provider softgarden e-recruiting GmbH, Tauentzienstraße 14, 10789 Berlin (applicant management tool). This is where our entire applicant management process is handled. You can find more information on application data protection at https://wieland-electric.softgarden.io/de/data-security?2.

If your application is unsuccessful, you have the option of allowing the personal data that you provided (such as in the cover letter, CV, certificates, applicant questionnaires, applicant interviews) as part of the overall application process beyond the end of the specific application process. This will enable us to contact you at a later date about future positions for which you may be eligible. The legal basis for this would be your consent pursuant to Art. 6 para. 1 (a) GDPR.

Otherwise, your data will be deleted 6 months after the end of an unsuccessful application procedure.

7.3 Newsletter

When we send out our electronic newsletter – to which you can subscribe – we process the data you have entered.

Specifying your e-mail address is obligatory to receive our electronic newsletter. The processing of additional data from you serves to personalise these contacts and allow for more specialised offers from us or companies associated with us.

We process your e-mail address in order to send you our electronic newsletter, to inform you of current events and any current developments and to maintain our contractual relationship with you. In addition, we use this data for promotional communications by e-mail and – if we have received your e-mail address in connection with our products and services – for promotional activities about our own similar products and services.

7.3.1 Tracking

By subscribing to the newsletter, the user consents to tracking for statistical purposes. A tracking pixel is used for this.  We use the product Sugar Market from SugarCRM Inc., 10050 North Wolfe Road, SW2-130, Cupertino, CA 95014, USA, for newsletter tracking. This service provider or the primary internal recipient of personal data from the U.S.A. is listed under the EU-U.S. Data Privacy Framework. The processing of personal data by this service provider or the primary internal recipient is therefore classified as trustworthy by the European Commission.

When the newsletter is delivered, the external server can then record certain data of the recipient, such as the time of retrieval, the IP address or information on the e-mail programme used (client). The name of the image file is individualised for each e-mail recipient by appending a unique ID, making it possible to determine which newsletter recipient has just opened the e-mail when the image is retrieved.

The personal data collected via tracking pixels in the newsletters is stored and analysed by us to optimise the sending of newsletters and to more readily adapt the contents of future newsletters to the interests of the recipients. The data is not disclosed to third parties.

The user can prevent tracking by setting the e-mail programme not to load images in an e-mail. We consider unsubscribing from the newsletter as a revocation of this consent.

7.4 Orders via our Online Shop

Registration in our shop to purchase our products via our online distribution is only possible for commercial customers. To this end, we will also ask you for personal data (name, e-mail address, postal address, telephone number, etc.). However, we will still make direct contact with you before activating our shop functions. The personal data that you provide us with here is used internally by the departments that deal with the processing of your enquiries and orders.  Your data may be combined and stored with the data of other orders that you send to us by other means (fax, post, telephone, etc.).

We process your personal data for the purposes needed in each case to fulfil the business relationship between you and us.

The personal data that you provide to us in order to make use of our shop offers is used by us to process your individual enquiries and orders, such as for the following purposes:

  • Checking your access authorisation
  • Your use of the shopping cart
  • Determining your individual prices
  • Internal handling of your order
  • Delivering the merchandise ordered
  • Payment transactions
  • Marketing measures

If necessary, we also employ the assistance of service providers (e.g. logistics service providers for sending your ordered products, banks for payment processing). We will only pass on your data to such third parties to the extent necessary for fulfilling these tasks. Third parties who receive data from our customers are obliged to comply with data protection regulations. Our legitimate interest in using external service providers, such as our logistics service provider for shipping the goods you have ordered, is to provide our services as efficiently and effectively as possible and thus as quickly and cost-effectively as possible for you.

We reserve the right to pass on your personal data to external service providers in order to carry out a credit check. This provides us with information about your previous payment behaviour and credit ratings. The data enables us to evaluate our customer relationship and is used by us to make delivery decisions and to protect us against payment defaults. This is also the basis for our legitimate interest.

If you have decided to open a customer account, we will use your personal data for the purpose of opening such a customer account.

The legal basis for the processing is the conclusion and fulfilment of the purchase contract for the ordered goods pursuant to Art. 6 para. 1 (b) GDPR as well as our legitimate interest pursuant to Art. 6 para. 1 (f) GDPR.

8.0 Use of Cookies

Cookies are small files which are stored on your hard drive by the browser you use and which receive specific information by the cookie being set. Cookies cannot execute any programs or transmit viruses to your computer. They serve to make the website more user-friendly and effective overall.

The storage of technically unnecessary cookies or the use of comparable technical functions takes place on the legal basis of consent pursuant to Sec. 25(1) of the Telecommunications-Telemedia Data Protection Act (TTDSG).

Any further processing of your data with the aid of a cookie is also based on your consent pursuant to Art. 6 para. 1 (a) GDPR. Technically necessary cookies are stored pursuant to the second sentence of Sec. 25(2) TTDSG.

You can find detailed information on the cookies used by us in our COOKIE BANNER

9.0 Transmission of Data to the USA

Based on a decision by the European Commission, the signing of the EU-U.S. Data Privavcy Framework (EU-U.SD. DPF) means that for registered service providers there is an adequate level of data protection for the transmission of personal data to the USA.

If your personal data is transmitted to the USA, the risk of losing control of your own data cannot be ruled out. For this reason, when selecting additional service providers from the U.S.A., we pay particular attention to registration in the EU-U.S. DPF register.  If this is not possible, Wieland will of course use the standardised European Standard Contractual Clauses (SCC) to oblige any service provider from so-called third countries outside the EU / EEA to comply with data protection regulations.

10.0 Web Analysis and Third-Party Services

10.1 Local Web Analysis

As far as local web analytics tools are used, the legal basis for this is our legitimate interest pursuant to Art. 6 para. 1 (f) GDPR. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

IP addresses are shortened or masked as soon as the data is received by Google Analytics and before it is stored or processed. The data is deleted after 26 months.
